TERMS OF SERVICE

Welcome to FolkRealms. These Terms of Service ("Terms") govern your access to and use of FolkRealms.com (the "Site"), operated by FolkRealms ("we", "us", or "our"). Please read these Terms carefully before using the Site.

BY CREATING AN ACCOUNT OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to all provisions of these Terms, do not access or use the Site. You must be at least 18 years of age to create an account or use the Site.

These Terms may be supplemented by additional guidelines, rules, or policies posted on the Site in connection with specific features. All such additional terms are incorporated by reference into these Terms.

1. LICENSE TO USE THE SITE

1.1 Limited License. Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable, limited license to access and use the Site solely for your own personal, non-commercial use.

1.2 Restrictions. You shall not: (a) sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site; (b) modify, create derivative works of, disassemble, reverse compile, or reverse engineer any part of the Site; (c) access the Site in order to build a similar or competitive platform; or (d) copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Site in any form except as expressly permitted herein.

1.3 Changes to the Site. We reserve the right to modify, suspend, or discontinue the Site (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

1.4 No Support Obligation. We are not obligated to provide technical support, maintenance, or updates for the Site, though we may choose to do so at our discretion.

2. YOUR ACCOUNT

2.1 Account Creation. You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2.2 One Account Per Person. Each individual may maintain only one account. Creating multiple accounts may result in termination of all accounts.

2.3 Account Security. You must notify us immediately at support@folkrealms.com if you become aware of any unauthorized use of your account or any other breach of security.

3. USER CONTENT

3.1 Definition. "User Content" means any text, images, photos, audio, video, artwork, and other materials you submit, post, or display on the Site.

3.2 Your Responsibility. You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that your User Content does not violate these Terms, our Community Rules, or any applicable law.

3.3 License Grant. By posting User Content on FolkRealms, you grant us a limited, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content on the Site solely for the purpose of operating and improving FolkRealms. This includes displaying your content to other users, featuring it within the Site, and maintaining system backups.

3.4 Ownership. You retain full ownership of your User Content. We will never sell, sublicense, or use your content for unrelated commercial purposes outside of FolkRealms without your explicit permission.

3.5 Moral Rights. You retain all moral rights and authorship of your User Content. We will not claim your work as our own.

3.6 Content Removal. If you choose to delete your User Content, it will no longer be visible on the Site. Copies may persist temporarily in backup systems but will be purged in due course. We also reserve the right to remove any User Content that violates these Terms or our Community Rules, without prior notice.

3.7 No Obligation to Backup. We are not obligated to back up your User Content. You are solely responsible for maintaining your own copies.

3.8 Feedback. Any suggestions or feedback you voluntarily provide about the Site may be used by us without obligation or compensation to you.

4. COMMUNITY RULES AND ACCEPTABLE USE

4.1 Community Rules. You agree to abide by our Community Rules, available at folkrealms.com/static/rules, which are incorporated into these Terms by reference.

4.2 Prohibited Conduct. You agree not to:

(a) Post content that is unlawful, harassing, abusive, threatening, harmful, defamatory, obscene, or that promotes violence, hatred, or discrimination against any individual or group;

(b) Post content that is harmful to minors;

(c) Impersonate any person or entity, or falsely claim an affiliation with any person or entity;

(d) Share personal information of others (doxxing) without their consent;

(e) Upload software, viruses, or code intended to damage or alter any computer system or data;

(f) Send unsolicited advertising, spam, chain letters, or promotional materials;

(g) Interfere with, disrupt, or create an undue burden on the Site's servers or networks;

(h) Attempt to gain unauthorized access to the Site, other users' accounts, or any systems connected to the Site;

(i) Harass, stalk, or interfere with any other user's use of the Site;

(j) Post AI-generated images or content, as outlined in our Community Rules; or

(k) Create or use bot accounts or automation tools for posting, commenting, or interacting on the Site.

4.3 Enforcement. We reserve the right to investigate any violation of these Terms and take appropriate action, including removing User Content, suspending or terminating accounts, and reporting violations to law enforcement when necessary.

5. AUTOMATED ACCESS, SCRAPING, AND AI TRAINING

5.1 Prohibition on Automated Access. You may not use any automated means, including bots, crawlers, scrapers, spiders, browser automation tools, or AI agents, to access, collect, harvest, or extract data from the Site or its users, whether for personal use, commercial purposes, or AI/machine learning training.

5.2 Prohibition on AI Training. You may not use any content from the Site, including but not limited to User Content, user profiles, posts, comments, images, or any other data, to train, develop, improve, or validate any artificial intelligence or machine learning model or system.

5.3 Prohibition on Data Collection. You may not collect, compile, aggregate, or store information about other users, including names, profile information, photos, posts, or any personal data, without their explicit written consent.

5.4 Rate Limiting and Detection. We employ technical measures, including honeypot systems, rate limiting, and behavioral analysis, to detect and prevent automated access. Triggering these systems may result in immediate and permanent suspension of your account and blocking of your IP address.

5.5 Exceptions. These restrictions do not apply to publicly available search engine indexing of our public pages, in accordance with our robots.txt file.

6. INTELLECTUAL PROPERTY

6.1 Our Property. The Site and its original content (excluding User Content), features, and functionality are owned by FolkRealms and are protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks. FolkRealms, our logo, and all related names, logos, and service marks are trademarks of FolkRealms. You may not use these marks without our prior written consent.

6.3 Copyright Policy. We respect intellectual property rights and expect our users to do the same. If you believe your copyrighted work has been infringed on the Site, please send a written notice to support@folkrealms.com containing:

- Your physical or electronic signature;
- Identification of the copyrighted work you claim has been infringed;
- Identification of the material on the Site that you claim is infringing;
- Your contact information (address, phone number, email);
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

We will respond to valid notices in accordance with applicable copyright law, including the EU Copyright Directive and the U.S. Digital Millennium Copyright Act (DMCA).

7. PRIVACY AND DATA PROTECTION

7.1 Privacy Policy. Our collection and use of personal data is governed by our Privacy Policy, available at folkrealms.com/static/privacy, which is incorporated into these Terms by reference.

7.2 Data Protection Rights. If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with data protection laws, you have certain rights regarding your personal data, including the right to access, correct, delete, and port your data. See our Privacy Policy for details.

7.3 Cookies. We use cookies and similar technologies as described in our Privacy Policy. By using the Site, you consent to our use of cookies in accordance with that policy.

7.4 Data Breach. In the event of a data breach that affects your personal data, we will notify you and the relevant authorities as required by applicable law.

8. THIRD-PARTY LINKS AND CONTENT

8.1 Third-Party Links. The Site may contain links to third-party websites or services not owned or controlled by FolkRealms. We are not responsible for the content, privacy policies, or practices of any third-party websites.

8.2 Other Users. We do not control User Content posted by other users and are not responsible for it. Any interactions between you and other users are solely between you and those users.

9. DISCLAIMERS

9.1 As-Is Basis. THE SITE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 No Guarantee. We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9.3 Jurisdictional Variations. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the maximum extent permitted by law.

10. LIMITATION OF LIABILITY

10.1 No Indirect Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLKREALMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE.

10.2 Maximum Liability. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED FIFTY EUROS (EUR 50).

10.3 Jurisdictional Variations. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FolkRealms and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.

12. TERMINATION

12.1 By Us. We may suspend or terminate your account and access to the Site at any time, for any reason, at our sole discretion, including for violation of these Terms. Upon termination, your right to use the Site ceases immediately.

12.2 By You. You may terminate your account at any time by contacting us at support@folkrealms.com or through the account settings on the Site.

12.3 Effect of Termination. Termination may result in the deletion of your User Content from our active databases. We will not be liable for any deletion of your content following termination.

12.4 Survival. Sections 3.3, 5, 6, 9, 10, 11, 13, and 14 shall survive termination of these Terms.

13. DISPUTE RESOLUTION

13.1 Informal Resolution. Before initiating any formal dispute, you agree to first contact us at support@folkrealms.com and attempt to resolve the matter informally for at least 30 days.

13.2 Governing Law. These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict-of-law provisions.

13.3 Jurisdiction. Any disputes arising from these Terms that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Ireland.

13.4 Individual Basis. All disputes must be brought in your individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding.

13.5 EU Consumer Rights. If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. GENERAL PROVISIONS

14.1 Entire Agreement. These Terms, together with our Privacy Policy and Community Rules, constitute the entire agreement between you and FolkRealms regarding your use of the Site.

14.2 Changes to Terms. We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Site at least 30 days before the changes take effect. Your continued use of the Site after the effective date constitutes your acceptance of the revised Terms.

14.3 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

14.4 No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.5 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms.

14.6 Electronic Communications. By using the Site, you consent to receiving electronic communications from us. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
